Subject: Demand Letter for $5,000.00 [Abuse and Neglect]

Dear Marilyn or Administrative Manager,

Concerning this case for November hospitalization from 11-11-03 to 11-13-03 (record #259186), and per W&I code, Title 9, and Title 22, I was abused, neglected, treated with lack of dignity, and privacy.  I was subjected to excessive medication, isolation and restraint.   I was denied reasonable telephone access, and reasonable access to water.   Treatment staff engaged into power struggles that severally jeopardized any chance for a therapeutic alliance, per progress notes.  

I flied a complaint with the state Licensing & Certification (L&C) in San Bernardino in May of this year against Victor Valley Community Hospital.  Licensing & Certification validated my compliant against Victor Valley Community Hospital on 09/09/04 after a solid investigation.  Victor Valley Community Hospital was sited by L&C for (1) excessive medication and restraint per W&I code and, (2) excessive medication and restraint per their own in-house QI policy.

Therefore, based on mistreatment and violation of Law, I am demanding the maximum amount of $5,000.00 for injury to my body and emotional harm I suffered as a result from the abuse and neglect from Victor Valley Community Hospital.

If I do not hear from you by October 13, 2004, with settlement, I will file an action with Small Claims Court (SCC) with Plaintiff's Claim (Form SC-100) against Victor Valley Community Hospital, et al.
